  • Women in crisis or emergency situations

SSS Maternity Benefit

The paid portion of maternity leave is funded by the Social Security System (SSS) through the SSS maternity benefit. The employer advances the payment to the employee, then claims reimbursement from SSS.

Computation

The daily maternity allowance is equivalent to 100% of the member's average daily salary credit (ADSC). The ADSC is computed based on the total salary credits for the 12-month period immediately preceding the semester of delivery.

Eligibility for SSS Maternity Benefit

  • The member must have paid at least 3 monthly contributions within the 12-month period immediately preceding the semester of childbirth or miscarriage
  • The member must have notified the employer of the pregnancy

Allocable Leave

The female worker may allocate up to 7 days of her maternity leave to:

  • The child's father (whether or not married to the mother)
  • An alternate caregiver — a relative within the 4th degree of consanguinity or the current partner of the female worker

The allocation must be done in writing and communicated to the employer.
